Terms of Service

1. Acceptance of Terms

By accessing or using Synerva ("the Service"), operated at https://synerva.app, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

Synerva is a software-as-a-service platform that allows users to create, customize, and publish launch pages, coming soon pages, countdown pages, and waitlist landing pages. The Service includes a visual editor, templates, hosted pages, and optional code export. Features and plans may vary; see our pricing page for current offerings.

3. Account Registration

To use certain features, you must create an account. You agree to provide accurate, current, and complete information and to update it as needed. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must notify us immediately of any unauthorized use.

4. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law or regulation
  • Infringe on intellectual property rights of others
  • Distribute malware, spam, or harmful content
  • Collect personal data from visitors without their consent and a compliant privacy policy
  • Impersonate any person or entity
  • Interfere with or disrupt the Service or its infrastructure

We reserve the right to suspend or terminate accounts that violate these terms or that we reasonably believe pose a risk to the Service or others.

5. Payment Terms

Paid plans are billed via Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis (monthly or annually) until you cancel. Prices are in the currency displayed at checkout. You may cancel at any time; cancellation takes effect at the end of the current billing period. We do not provide refunds for partial periods. Refund requests may be considered on a case-by-case basis.

6. Intellectual Property

The Service, including its design, code, and branding, is owned by us or our licensors. You retain ownership of content you create (text, images, designs you upload). By using the Service, you grant us a limited license to host, display, and process your content as necessary to provide the Service. When you export code, you receive a license to use that exported code for your own purposes, subject to any third-party licenses included therein.

7. Data and Waitlist Collection

If you use our waitlist/email capture features, you act as a data controller for the personal data collected from your visitors. You are responsible for ensuring your use complies with applicable data protection laws (e.g., GDPR, CCPA) and that you have a privacy policy and lawful basis for collection. We process such data on your behalf as a processor; see our Privacy Policy for details.

8. Limitation of Liability

To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind. We disclaim all warranties, express or implied. We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill. Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim. Some jurisdictions do not allow certain limitations; in such cases, our liability is limited to the maximum permitted by law.

9. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason. You may terminate your account at any time. Upon termination, your right to use the Service ceases. Provisions that by their nature should survive (e.g., intellectual property, limitation of liability) will survive.

10. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance. If you do not agree, you must stop using the Service.

11. Governing Law

These Terms are governed by the laws of the jurisdiction in which we operate, without regard to conflict of law principles. Any disputes shall be resolved in the courts of that jurisdiction, unless otherwise required by applicable law.
